    In view of the Supreme Court Judgment (Judgment No. 952/2021) communicated to the parties today, Ribera wishes to state the following

    The Supreme Court upholds the appeal filed by Ribera against the ruling issued by the Fifth Section of the Administrative Litigation Chamber of the Superior Court of Justice of the Valencian Community, dated October 15, 2019, which is annulled. 

    The Supreme Court thus establishes a before and after in the reversal processes of public administrations in Spain. From now on, the doctrine has been defined that will oblige all public administrations to justify the repercussions and financial and budgetary effects derived from the decision to reverse a concession.

    This unprecedented sentence represents a great guarantee of budgetary stability and control of public spending, since it prevents administrative decisions based on arbitrary and ideological criteria whose negative economic effects citizens must pay for. At the same time, it also supposes a guarantee of the principle of transparency to the extent that citizens will know, prior to its adoption, the economic consequences that the decisions of their rulers will have.

    This new doctrine fully affects the reversal process of Torrevieja because it shows that the reversal model initiated by the Generalitat has been done improvised and without consensus, and now also, according to the Supreme Court, illegally, since In this case, the repercussions and financial and budgetary effects of the decision have not been justified either. 

    Faced with this new reality, from Ribera we positively value this turning point that implies the need to justify reversals above political and arbitrary decisions. In the same way, we continue to maintain our desire for dialogue and consensus with the Generalitat to prioritize the health of citizens and care for our patients in the face of ideological dogmatism.

    In the case of the Alzira hospital, despite the fact that the Supreme Court has not annulled the "non-extension" of the concession contract, because "it cannot be ruled out that an assessment of said repercussions had not been made", two of the magistrates of the Supreme Court have expressed a particular vote against this decision.
